As we enter February, your BCBA Board is proud to join the nation in celebrating Black History Month, honoring the profound, often overlooked contributions of Black Americans to our culture, history, and society. This month of reflection inspires BCBA’s ongoing commitment to diversity, equity, and inclusion, which we strive to uphold year-round. February is a busy month for us! The BCBA office will soon be moving, so watch your email to keep up with when we are officially moved. Our new office space will be at the Boulder location of Office Evolution. This new setup offers the opportunity for some exciting new event space, as well as some different kinds of events for our members. Make sure to read those email alerts! On February 6th and 7th, we will be hosting the 2026 Mock Trial Competition, which features high school students. This year we have four more teams than our previous largest participation year! It is great to see high school students showing such interest in the mock trial program. However, it also means we need even more volunteers than years past. Please join us in judging at least one round this year by signing up here. Also encourage your friends and family to sign up for a shift – non-lawyers are absolutely encouraged to participate.

By the time you see this, we will have already held our bowling event. But don’t worry, this month we also have lots of great CLEs, as well as pickleball. And planning is underway for the newly re-imagined fundraiser for Legal Services (formerly Jazz for Justice) Pro-Bono Bash event in April. Last month I wrote about my intentions for 2026. How are your intentions, or resolutions, going for the year? If yours included giving back, mentoring, connecting more with the BCBA, or working with or helping youth, then our Mock Trial Competition is the perfect opportunity for you! I recently read an article on habits (yes, I am that person), and it discussed a study that found people with a habit of eating popcorn at the movies ate more stale popcorn than those without the habit. Apparently, those with the movie popcorn habit later reported that they could tell the popcorn was bad but continued to eat it. Apparently, this was because the behavior was triggered by the context. In their minds, you eat popcorn at the movies, even ignoring that it is stale. Bad popcorn is one thing, but applying this finding to more significant bad habits is where the implications become more serious. For instance, invisible habits you don’t consciously consider but that impact your work-life balance or your sleep quality. A common example is grabbing your phone to check one thing and then automatically opening social media, the news, messaging, etc. - before you know it, you’ve lost a significant chunk of time. Our lives are made up of a multitude of habits, some bad, some good, and some neutral. The key is identifying those that are working against you. I don’t have a connection between popcorn and movies, so I don’t have to worry about stale popcorn, but I do need to identify those subconscious habits working against me. They are definitely there, and some are more than visible but finding the invisible ones is crucial to making progress. We have a copy of Atomic Habits by James Clear at the house, so it may be time to actually open it up. Here’s to hoping your February is full of opportunity and joy, while short on stale popcorn. As I close out January, I am off to a PWHL (Professional Women’s Hockey League) game in Denver, where I will cheer for a team from elsewhere (Go Seattle!) and join in the locals’ chant of “We want a team.” Keeping with my resolution of finding some joy away from work as we wrap up the first month of 2026 and keeping up hope that Colorado will get one of the next PWHL expansion teams.

a new Chapter: BCBA office move Laura ruth, executive director
It's hard to believe it's been 7 years since the BCBA moved into our offices on 28th Street. We had a grand vision of a community hub where members would come together and co-work, attend live CLE programs, and just stop by to say hello. We moved in April of 2019 with great excitement and started off fulfilling our vision with events like our monthly Side Bar program. We immediately signed up several co-workers who were excited to have a secure place to work and meet with clients. We didn't even make it a year before the world changed. Covid hit in March of 2020, and we found ourselves in a large empty building. In some ways this was a blessing, as Kyle and I were able to continue coming into work since there was plenty of room to socially distance. As a mom of 2 daughters and 3 stepchildren who were remote learning, I am eternally grateful for that. Reopening happened slowly, and we never got back our momentum. Members discovered that they liked working from home in many instances and several were wary to go out for quite some time. I knew the BCBA would need to pivot to reflect the new reality, so with the board's expert guidance we began the process of reinventing ourselves and creating an association that would bring community and value to our membership in new ways. The free virtual CLE's were born, but we knew we needed to keep including community for those members who still wanted to get together. This was the birth of the monthly social events and our weekly Bagels with the Bar. Last year, we said goodbye to Kyle Mares who moved on after 7 years with the Bar and welcomed Bay Shogrin who is bringing fresh energy and ideas to her role. It seemed like a perfect time for a new chapter. Discussions of a lease renewal with the board led to the consensus that we didn't need all the space we have, but we still needed that community aspect. The search began for a new home. When we visited Office Evolution, the board knew this would be a great alternative for the BCBA. The Pearl East Circle area already houses several law firms, and a quick Google search showed us there are around 40 of our members in the immediate area. Plus, there is a fantastic amenity called Basecamp which will allow us to hold events in a beautiful space. We've begun the move already, and look forward to hosting our first Bagels with the Bar in the new location on Wednesday, February 11 from 8:30 - 10 am. These will continue to happen weekly at either the office or one of our Bagels on the Road locations. We're also looking forward to some casual food truck gatherings when the weather improves. Through the Boulder County Bar Association's continuous commitment to access to justice, we have decided to bring back our in-person legal clinics and we have expanded them to include a community resource fair. On Saturday, January 24 the BCBA held its first in-person legal clinic since COVID. In total, we were able to assist 34 people through the legal clinic and received positive feedback about both the legal clinic and community resource portion of the event. A Look Back, and a Strong Year Ahead As we move into a new year, it’s a good time to reflect briefly on the past twelve months and to look ahead to what’s coming for the Trusts & Estates Section. The Past Year: Practical, Substantive, and Grounded Over the past year, the Section’s programming focused squarely on the realities of modern trusts and estates practice. Estate planning today requires more than solid drafting. It requires staying current on evolving strategies, understanding how plans are implemented, and appreciating how documents function once they are tested in the real world. Our programs emphasized: Contemporary planning strategies and how they work in practice. Drafting decisions that carry long-term consequences during administration. The interaction among planners, fiduciaries, beneficiaries, and advisors in increasingly complex estates. Participation and engagement were strong throughout the year. The most valuable moments often came during discussion, when practitioners raised real questions from real files. That exchange of experience is one of the strengths of this Section. Our Focus Going Forward The Trusts & Estates Section exists to support excellence in planning and fiduciary practice. While contested matters are part of the landscape, our emphasis remains forward-looking. Good planning anticipates change, manages risk, and reduces uncertainty before problems arise. Our goals are straightforward: To keep practitioners current on developments that meaningfully affect planning and administration. To promote careful, thoughtful drafting that reflects both legal requirements and human realities. To support sound professional judgment in advising families and fiduciaries over time. Those priorities will continue to guide our programming in the year ahead. Opening the Year: Probate Litigation and Arbitration We’re beginning the year with a program that looks at what happens when plans are tested. Our first program will feature The Honorable Patrick M. Collins, District Court Judge, and Patrick J. Butler, District Court Judge (Ret.), in a discussion focused on probate litigation and arbitration. This topic was chosen intentionally. Even the most carefully constructed estate plans can encounter friction during administration. Disputes over capacity, undue influence, fiduciary conduct, or interpretation are not uncommon. Understanding how courts view these issues, and how arbitration and other dispute resolution mechanisms function in this setting, helps practitioners become better planners as well as better advocates. The program will explore: How probate disputes commonly arise from planning and administration decisions. Judicial perspectives on recurring issues in contested estate and trust matters. When arbitration and other ADR tools are effective, and when they are not. Practical observations planners can incorporate into drafting and client counseling. Hearing from both a sitting district court judge and a retired district court judge offers a rare opportunity for candid, experience-based insight that is difficult to obtain.

Setting the Tone for the Year Beginning the year with this program reflects the Section’s broader approach. Effective trusts and estates practice requires technical skill and creativity, but also an understanding of how documents and decisions perform under pressure. By pairing forward-looking planning education with a clear-eyed look at litigation and arbitration outcomes, the Section aims to support practitioners in delivering work that is both sophisticated and durable. An Invitation The Trusts & Estates Section thrives because of its members. Participation, engagement, and the willingness to share experience are what make the Section valuable. We look forward to a year of substantive, practical programming and hope you’ll join us at our upcoming events. Chair’s Note Hello, and welcome to both new and returning members of the Trusts & Estates Section. My name is Diedre Braverman, and I’m honored to serve as Chair of the Trusts & Estates Section of the Boulder County Bar Association. I’ve been practicing trusts and estates law for more than twenty-five years, and I continue to find this work intellectually demanding, humbling, and deeply engaging. Serving this Section is a genuine pleasure. Boulder County has an unusually thoughtful and collegial trusts and estates bar, and I’m grateful for the opportunity to help shape programming that reflects how we actually practice, not just how the law looks on paper. Join the Legal Aid Foundation’s Most Important Campaign of the Year Be a Leader, Compete for Justice, Make an Impact The Legal Aid Foundation of Colorado is inviting firms and corporate legal departments to join the 2026 Associates Campaign and Corporate Counsel Challenge, a month-long, statewide effort to raise $550,000 in support of Colorado Legal Services. Participation is simple but makes a huge impact. The Legal Aid Foundation will provide all campaign tools, including a customized fundraising page and optional engagement events at your office. Teams compete for awards and participants will be recognized at a celebration in April, as well as at region-specific events in Colorado Springs and Boulder. This friendly competition celebrates generosity and strengthens our collective ability to ensure Coloradans facing crises have access to vital civil legal help.
